These Terms of Service (“Terms”) govern access to and use of Rise Growth OS (the “Application”), operated by Rise (“Rise,” “we,” “us,” or “our”). By accessing or using the Application, you agree to these Terms. If you do not agree, do not use the Application.
Our handling of personal information, including Google user data, is described in our Privacy Policy, which is incorporated by reference.
1. The Application
Rise Growth OS is the growth and operations software for Rise telemedicine. It may include patient intake experiences, campaign analytics (including Google Ads reporting), leads and contact tools, order visibility, communications workflows, and related internal dashboards for authorized users.
Clinical care, prescribing, and pharmacy fulfillment may be provided through Rise and its licensed partners under separate consents and notices presented in the intake or care flow.
2. Eligibility and accounts
You must be legally able to enter into these Terms. Ops dashboard and CMS access are limited to authorized Rise personnel and approved collaborators. You are responsible for safeguarding login credentials and for activity under your account.
3. Acceptable use
You agree not to:
- Misuse the Application or attempt unauthorized access
- Interfere with security, rate limits, or infrastructure
- Use Google or other third-party integrations in violation of their terms or applicable law
- Upload unlawful, harmful, or infringing content, or misuse patient or customer data
- Reverse engineer or resell the Application except where prohibited restrictions are disallowed by law
4. Google and third-party services
The Application may integrate with Google (Sign-In, People API, Google Ads API) and other providers. Your use of those services is also subject to the third party’s terms and privacy policies. Rise is not responsible for third-party services we do not control.
Google user data obtained through Google APIs is used only to provide or improve Application features, as described in the Privacy Policy, and not for prohibited advertising, brokerage, or non-personalized AI/ML training uses.
5. Intellectual property
The Application, including its software, design, trademarks, and content (excluding your submitted data), is owned by Rise or its licensors. These Terms do not transfer ownership to you. You may not use Rise branding in a way that confuses others or implies endorsement without permission.
6. Medical disclaimer
Rise Growth OS and related websites provide software and information tools. They do not replace professional medical advice, diagnosis, or treatment except where a licensed clinician delivers care through Rise’s telemedicine partners under applicable consents. Always seek the advice of a qualified health provider with questions about a medical condition.
7. Disclaimers
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APPLICATION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APPLICATION WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID TO RISE FOR THE APPLICATION IN THE TWELVE MONTHS BEFORE THE CLAIM.
9. Indemnity
You agree to indemnify and hold harmless Rise and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Application, your violation of these Terms, or your violation of applicable law or third-party rights.
10. Suspension and termination
We may suspend or terminate access to the Application if you violate these Terms, create risk or legal exposure, or if we discontinue the product. Provisions that by their nature should survive will survive termination.
11. Changes
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in that jurisdiction will have exclusive venue for disputes, subject to applicable law.
